Terms of Use
Version 2026-10-26 · Privacy Policy · Cookies
1. Who we are
OpenConstruction Academy (openconstructionacademy.com) is run by Artem Boiko, Kraichgaustraße 3, 76676 Graben-Neudorf, Germany (e-mail info@datadrivenconstruction.io). These terms apply when you create an account or take a course. Public video pages can be used without an account.
2. Your account
- You must be at least 16 years old.
- Give a working e-mail address that you control. You sign in with a link sent to it; anyone with access to that mailbox can sign in.
- One account per person. Do not share your account or forward sign-in links.
- Tell us at once if you think someone else has used your account. You can end all sessions in the account area.
3. Acceptable use
Do not: break or probe the security of the site; use bots to create accounts or request sign-in links; scrape or bulk-download course content; get around access to paid courses; upload unlawful or harmful content in course tasks; or use the service to break the law or anyone's rights.
4. Course content
Courses, videos, texts, tasks, sample projects and data belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use them for your own learning. You may not copy, publish, resell, redistribute or use them to train others, unless we agree in writing. Your rights in OpenConstructionERP itself follow its own open-source licence. Your own answers and work in tasks stay yours; you give us the right to store and process them to run the course.
5. Free and paid courses
- Free courses and the free part of a course are free. We may change or retire free content.
- Paid courses show their price before purchase. Access is linked to your academy account.
- How long paid access lasts: [TO CONFIRM: lifetime of the course, or a fixed period].
5a. Newsletter
The newsletter is optional and separate from your account. If you buy a paid course, we may e-mail you about similar academy courses; you can opt out at purchase, in the account area or with the link in every mail. See the Privacy Policy.
6. Buying a paid course
Paid courses are sold by our merchant of record, [TO CONFIRM: name, address and privacy policy link of the merchant of record]. The merchant is the seller of record: it takes payment, charges VAT or sales tax, issues the invoice and handles refunds and payment questions under its own terms, which you accept at checkout. After payment the course is unlocked on the academy account with the e-mail you use.
7. Right of withdrawal (EU and UK consumers)
If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a purchase of digital content without giving a reason.
Immediate access. A paid course is digital content that is not on a physical medium. If you want access straight away, at checkout you are asked to (1) expressly agree that the course starts before the withdrawal period ends and (2) acknowledge that you thereby lose your right of withdrawal once access begins. We confirm this in your purchase confirmation. If you do not give this consent, access starts after the 14 days. [TO CONFIRM: confirm the merchant's checkout shows this consent and acknowledgement and records it]
To withdraw where the right applies, contact the merchant of record or us with a clear statement. Refunds are made by the merchant to the original payment method within 14 days. Voluntary refunds beyond this: [TO CONFIRM: refund policy, if any].
8. Certificates and badges
If you request a certificate, we ask for the name to print on it. Certificates and badges confirm that you completed the tasks of a course on this site. They are not an accreditation, licence, degree or professional qualification, and are not recognised by any authority or professional body unless a course says so explicitly.
9. Availability and changes
We try to keep the service available but cannot promise it will always be free of interruptions or errors. We may improve or change courses. We will not remove the core of a paid course you bought without offering a fair remedy.
10. Lessons are not professional advice
Lessons show methods on sample projects. Laws, standards and prices change and differ by place. Check the rules that apply to your project before relying on a lesson; this is not legal, tax or engineering advice.
11. Liability
We are fully liable for intent and gross negligence, for injury to life, body or health, and wherever liability cannot be limited by law (for example product liability or mandatory consumer law). For slight negligence we are liable only for breach of an essential obligation and only for foreseeable, typical damage. Otherwise we are not liable. For free content, our liability is limited to the extent the law allows. Nothing here reduces your statutory rights as a consumer, including your rights if digital content is faulty.
12. Ending your account
You can delete your account at any time in the account area; it is locked at once and erased within 30 days (see the Privacy Policy). Deleting it ends access to paid courses. We may suspend or close an account that seriously or repeatedly breaks these terms, after a warning where reasonable, and inactive accounts are erased after 24 months (we e-mail you first). If we close an account without cause, we refund unused paid access pro rata. [TO CONFIRM: pro-rata refund rule]
13. Changes to these terms
We will tell signed-in learners about material changes before they apply and ask you to accept them on your next sign-in. If you do not accept, you can delete your account.
14. Law and disputes
Governing law: [TO CONFIRM: governing law and courts, e.g. Germany, without removing consumer protection of the learner's country]. If you are a consumer, you keep the protection of the mandatory law of your country of residence. We are not willing or obliged to take part in dispute resolution before a consumer arbitration board.
